Car vs. tree on Summer Trees Road

(near #1 Summer Trees Road)

Port Orange, Fl.

===========================

It looked to me that two young gentlemen had been in the vehicle.

One seemed to be ok and was giving the officers information,

the other was on the stretcher and I guess was taken to a hospital.

Some residents were standing around noting that

the car was probably not driving in the posted speed limit

of 25 MPH.  And one woman remarked,

"and we often have turtles crossing the road."

Accident on I-95

about 1 mile north of the Pioneer Trail Overpass,

on the center divider, north bound.

April 7, 2008 at about 4:30 PM

Female driving the vehicle went off the road

and into the bushes, traveling about 45 feet

parallel to the highway before coming to a

stop.  I heard that the vehicle had rolled over.

The injured female was fortunate that a

witness saw the accident and stayed

at the scene to show fire rescue where

the damaged vehicle was, because

it could not be seen from the roadway.

Air one was requested, but could not fly

because of the weather.

FROM PORT ORANGE POLICE DEPARTMENT

APRIL 10, 2008

Officer Fouts responded to a three car accident at the intersection of Taylor Rd and Clyde Morris Blvd along with other officers. Subject Philip Miller (10/06/38 of Port Orange) who was not involved in the accident was upset that the traffic was not moving very fast due to the crash and that Officer Fouts had stopped his particular lane to allow an emergency vehicle to get by the accident scene.

Miller was cursing out his window at passing motorists. Miller revved his vehicle when approaching Officer Fouts and failed to stop when Fouts directed him to stop for the passing emergency vehicle. Officer Fouts had to move out of the way from Miller as he thought he would have been struck by Miller if he had not taken evasive action. Officer Fouts then asked Miller for his drivers license as he approached his drivers window due to his aggressive driving. Miller continued to yell and shake his fists at Officer Fouts. Fouts observed Miller not wearing his seatbelt. Fouts asked Miller for his drivers license. Miller shoved his drivers license out the window to Officer Fouts. Officer Fouts told Miller to pull off to the side road so he could issue him a seatbelt citation and tried to explain to him why the traffic was backed up in the area (three car accident). While Officer Fouts was trying to explain to Miller about the traffic obstruction (accident), Miller drove his vehicle in a reckless manner towards another officer who was working the traffic accident with his back to Miller and Fouts.

Miller pulled his vehicle over and got out of his car in an aggressive manner continuing to yell and swing his arms. Officer Fouts advised Miller to get back into his vehicle and was planning on issuing him a citation for not wearing his seatbelt. Miller refused to do so and continued to yell at Fouts. Officer Fouts attempted to place Miller under arrest for resisting his commands to get back into his vehicle. As the officer took hold of Miller's wrist, Miller pulled back and assumed an aggressive fighting stance with both fists clenched towards Fouts. Other officers on the accident scene assisted in getting Miller secured in handcuffs without further incident.

Miller was charged with the following charges:

Assault on a police officer
Resisting arrest without violence
Failure to obey a police officer
refusal to accept and sign a citation
Reckless driving

He was transported to VCBJ on $4,250 bond.

A poi reader writes:

On the way to the ....... Saturday, we actually were run off the road in that spot. We were trying to merge onto i-95, suddenly had a pile of brake lights in front of us, and had to swerve into the grass to avoid an accident. then we waited literally 3-4 minutes before there was a traffic break long enough to allow us to get back on the road. With that overpass, the on-ramp, and then the curve in the road, it's a dangerous spot. and I can't imagine what the traffic will be like in the next year plus as more commercial stores open up in the area.

POI IMAGES

If you look closely,
you can see a tail light of the vehicle in the bushes.

See the taillight in the woods?

I am standing taking this picture
at the spot where the vehicle
entered the bushes,
and went about 45 feet
parallel to the highway
and finally stopped
in the hidden bushes
where the EVAC personnel are standing.
At this time, Fire rescue is
searching the bushes and the wreck
to make sure that there was not
a second person in the vehicle.

This is the path the vehicle took
as it drove parallel to the highway.
Look hard, and the brown spot
way down deep in the middle
is the clothing gear of a fire rescue personnel.

With the zoom lens
you can see the fire personnel
standing near the wrecked vehicle.
