Are you offended at the sight of a man dieing, or dead, nailed to a cross?

Perhaps not, unless the image is one of your beloved.

Are you offended by the images of dead people in news documents

showing the story of the Holocaust?  Probably you are disgusted,

but know the story should be told and never forgotten by humanity.

Port Orange Images reports the news of the Port Orange area,

and many times the images show accident scenes, or crime scenes.

POI showed the image of a man being treated for a stab wound, of which

he later died.  There was the image of a woman shot on her bicycle,

at 2 am one morning. At an accident scene, a yellow blanket covered

the body of the man killed when his car landed on top of him.

POI some times gets complaints from friends and family members when such

images are published.  POI Hank is wrestling with the problem of telling

the whole story, with pictures, and yet not offending family members.

Help me decide if pictures of the injured should be shown on the POI web site.

Let me know what you think. --- poimages@cfl.rr.com

I had been yielding to a few opinions

that POI should not publish the faces of the injured

in public safety incidents,

especially if blood or pain is visible.

But, after getting a slew of commentaries

personally attacking my character

and audacity to publish images that

those people prefer not to allow others to see,

I am tending to think that I need to assert

my first amendment rights,

and show the whole story of incidents which I

have taken the time to report to the POI community.

I will try to give a caveat to POI readers

that such images or POI video might

be too graphic for some viewers,

so viewer discretion should be applied.

Special consideration will be given to

images and videos in order to

not unnecessarily offend the families

of members killed in public safety incidents.

L.A. police arrest photographers near Spears' home

LOS ANGELES (AP) -- Two photographers suspected of loitering on city-owned property near Britney Spears' home were arrested Monday.
Alexandre Passos of Canoga Park and Eduardo Ravalha of Los Angeles, both 35 years old, were arrested around 6 p.m. Monday after being warned to leave an access road near Mulholland Drive and Coldwater Canyon Avenue, police spokeswoman April Harding said.
The road is near the exclusive gated neighborhood that Britney Spears and other celebrities, including Ed McMahon, call home.
Ravalha's car was also impounded, Harding said. The pair were released, she said.
They had been warned once about leaving the road but were still on it when officers returned about 45 minutes later, Harding said.

POI is in the process of starting up a second web site

which will provide a solution

to avoid posting video community news on You Tube.

I had better get working on the new web site.

I think I will spend tomorrow, Sunday, devoted to starting up

the new web site for POI videos.

I am not sure what technical problems I might come across.

By the way, channel 9 TV news, wftv, central florida, ran some of the

video on its news cast. The following day, the mother and son who

were arrested for stealing the copper at the Volusia Fair Grounds

were connected with 20 such thefts in various counties, from ATT

towers.

Federal law on animal cruelty videos

struck down

Overturning a Virginia man's 2005 conviction, a U.S. appeals court says that depictions of dogfighting and other acts are protected by the 1st Amendment.
By David G. Savage, Los Angeles Times Staff Writer
July 19, 2008
WASHINGTON -- In a setback for the animal rights movement, a U.S. appeals court Friday struck down on free-speech grounds a federal law that made it a crime to sell videos of dogfighting and other acts of animal cruelty.

All 50 states have laws against the abuse of animals, the appeals court said, but "a depiction of animal cruelty" is protected by the 1st Amendment.  . . . .

POI HANK COMMENTS:

I do not want to publish pornography, cruelty to animals or people.  And I do not want to publish "blood and guts",
but I do think that publishing blood on the face of a person
involved in a public safety incident or a body covered with a yellow blanket is not outrageous.

The concern for family members needs to be intertwined with the right and desire of the public to see the whole story.

I am taking steps to keep my public safety videos off of you tube, where perhaps family members of victims might stumble on the videos.  And caution caveats will be posted at the front of videos and digital still images which might contain blood
or a body covered with a blanket.

I think this kind of policy will be fair to all.

At the scene of an accident the other day, where a young man destroyed his expensive car, and his passenger went to the hospital, an onlooker commented that at the speed he was going, the driver could have run over a turtle, because we have many crossing the road in this 55 plus community.

I am starting to think, that trying to cater to all the whims
of the public, when the first amendment give me certain rights,
is counter productive to reporting the news.

=================

July 12, 2008 at  12:42 PM:

This video was sold for use to a TV channel news station, central Florida. It probably was the case that any frames showing the person of the injured were not used.  The frames in the POI video of the injured person did not show the face of the injured person.

I think the news media are sensitive to complaints that might affect their advertising sponsors.  I have no such concern, but do have a concern that I do right by families connected with a tragedy.

Some time ago, I guy who was hanging around a roll over accident, looking, came over to me and voiced his displeasure at the news media showing the faces of the injured in accidents.  Some how I guess he can handle standing around looking at a bloody woman being professionally treated by our fine medics, but did not think that other people should see such a scene, which he was interested in to remain at the site and observe.

After that incident I invited POI readers to respond to the issue, and only 13 readers responded.  8 were of the opinion that the faces of injured should not be shown on the poi web site.  2 out of the eight were my family members.  5 readers thought that the injuries in accidents should be shown as part of the whole story for the public to be aware of what is going on out in the public safety sphere. (I generalize)
Dorothea of L.I. pointed out that especially when someone is hurt and is the victim of a wrong doing, the injuries on that person should be shown to attest
to the crime or wrong doing or fault in an accident. (I paraphrase her comments, not having them at hand to copy and paste.)

I think Dorothea's observations were very much on the mark, because those who have complained about POI hank's videos
showing the injured, have been alleged family members of the injured, when I would surmise the injured family member
might have been in the wrong.

If I remember correctly, the driver who was killed in the Samsula accident was at fault for violating the right of way of the other vehicle.  I have heard that a member of his family complained about my digital still images of the deceased covered in a yellow blanket.  I removed the images from this web site when I heard there was a family complaint. You can read more on this incident at Accidents in New Smyrna Beach Fl

Most POI readers do not complain about the images and video published by POI Hank.  A sample poll of 13 people is not significant, but I think it means something, when most people do not respond or perhaps care what is published on POI web site.

I have related how once, when a young man apparently was driving too fast and not wearing a helmet, went down on his motorcycle.  The mother came to the scene and grabbed my camera and tried to take it away from me.  Two policemen came over to stop her from her assault.  If he were not at fault, I wonder if she
would not have mind pictures being taken to
show the guilt or mistake of another driver?

Out on the streets, I have been yelled at that I will be sued, maybe 6 times.  In one case, it was a situation where the driver had struck a person in the roadway.

The Daytona Beach News-Journal used one of my digital still images.  The female victim had been shot and killed on her bicycle, at 2 am in the morning besides a tall condo in Daytona Beach Shores.  The image was startling, because the headlights of a police car was shinning on the body, somewhat like a spot light on a stage, while the crime scene was being protected for investigation by detectives.

The image showed the victim's legs and bottom torso draped over the bicycle, but not the face of the victim.  In this case, the concern was for the victim's family, although I don't think the victim's family had written to the News-Journal to complain.

I have made it a policy to not show the face of an injured person, based on the small poll finding I ran.  But, I have had it in my mind to show the face of the injured when another person is at fault for the crime or the accident as Dorothea of L.I. had suggested.

In the instance of the school teacher from New Smyrna Beach, who was liked by many people,
I did make reference to the Daytona Beach News-Journal article which featured how well liked the gentleman was and how he will be missed.

I understand that in the accident that killed him,
he was showing two students how to ride bicycles, or do I have that wrong?  In any case,
as I understood what happened, the gentleman
was for some reason in the highway part of the bridge that went over railroad tracks.  And from what I could see at the accident scene, he
was on the blind crest of the top of the bridge.

Ok, so I am the jerk to be showing such pictures.
And I know, especially in my old age, for some
God unknown reason, I too might find myself
making a mistake on the highway and getting myself killed.  God, how I hope I am not the
cause of another getting hurt or killed.

I do not want to unnecessarily hurt family members, but I would like to be free to show the full story, and the results of the carnage on our
Florida highways.   I am not sure what my policy will be, but I will look for some way to accommodate the sensitivities of family members.

Therefore, I will be eliminating the video of the teacher who had been killed while riding a bicycle over a bridge, and this deletion will be
on Monday, July 14, 2008.  If you want to see that video and read the comments from viewers go to
http://www.youtube.com:80/watc
h?v=WaaWj7rsToA&feature=email

I worry that the public might think they can dictate what can be shown on web sites such as mine.  The second amendment is still around, but there seems to be some who think they can sue or call someone a jerk if what is published does not suit them.
